Owning property in Mexico

When you do buy a Real Estate located in our Mexican beaches, or located in our
Mexican borders and you are a foreigner, you will need a Trust in what is called the
“Restricted Zone”. In order to make this a pleasurable experience, Riviera Maya

According to Mexican Laws, a foreigner or foreigner Companies who try to acquire
a Real Estate in a “Restricted Zone” for residential or touristy use, require a
TRUST, which is a legal instrument that according to Mexican laws must be
constituted by a Financial Institution throughout a contract given before a public
notary.
As a result, it gives to the foreigners, the security to use and enjoy the Real Estate
they want to buy, meanwhile the bank, as a Trustee, keep the direct property of the
Real Estate.
This kind of contract for the foreigners, have been used for more than 50 years,
offering legal security to the buyers of the Real Estates in México.  

For the disposition of the Real Estate, in case the Beneficiary wanted to sell the
property to other people (Mexicans or Foreigners), it is necessary for the Trustee to
receive instructions from the Beneficiary by mail (with all the legal requirements,
such as apostilles, certifications, etc.) to make the transfer of the property or the
Beneficiary’s rights to the buyer, and obviously the Beneficiary can receive the
payment in exchange.

Buying a property throughout a Trust is very secure, it is a contract that has been
used by many people since long time ago; it is signed before a Mexican Public
Notary and listed in the Public Property Registry and in the National Registry of
Foreign Investment.
